A man suspected of killing a kitten is headed to trial on felony charges.
After a Friday preliminary hearing inTuolumne County Superior Court, Judge
Doug Boyack declined to reduce the animal cruelty charge from a felony to a
misdemeanor for Steven Bruce Tippett, 51.
Instead he ruled that there was probable cause that he was guilty of a
felony.
On Oct. 25, Tippett called Animal Control to report a cat had bitten and
scratched him as he was trying to get it out of a tree, Tuolumne County
Animal Control Officer Teri Elam said.
Elam told Tippett that he should bring the cat into the office so officers
could quarantine it to ensure it didn't have rabies.
She said she told him he could borrow a live trap from the office, but he
never showed up to pick one up.
Four days later Tippett came to the office with the dead kitten in a
cardboard box, Elam said. He told her he was trying to put it in the box
and it jumped out. When he tried to put it in the second time, he choked it.
"He said he was frustrated," she said.
Dena Marshall, whose mother is Tippett's ex-wife, was there when the
incident allegedly occurred.
Tippett was living with her in a home on Hatler Drive near
Standard,Marshall said. She and her mother had six kittens at the residence.
The kitten was trying to get outsidewhen he grabbed it with a towel andput
it in the box, strangling it, Marshall testified. He used the towel to wrap
around its body to keep it from scratching him, she said.
"After he killed it, he said, 'There, it's done,' " she said. "He had a
realsadistic look on his face."
Tuolumne County Animal Control Officer Waynette Townsend testified that she
took pictures of both Tippett's hands and the cat's carcass.
Tippett had a fresh scratch on his right hand, and an older healing wound
on his left forearm above his wrist, she said.
An area veterinarian performed a necropsy — an autopsy for an animal— and
found there was trauma to the cat's head, Townsend said.
Deputy Public Defender Clay Bedford asked the judge to reduce the charge to
a misdemeanor, pointing out that Tippett has had noprevious felonies.
"No matter what you think about cats and animals, this behavior just
doesn't amount to felony behavior inwhich Mr. Tippett should be sent to
prison," he said after the hearing.
Deputy District Attorney Jim Newkirk countered that Tippett has previous
convictions of violating a domestic violence order, disturbing the peace,
brandishing a deadly weapon, drunk in public and methamphetamine possession.
Tippett was told about a humane way he could have trapped the cat in order
to avoid injury. But instead,Newkirk said, "He chose to take matters into
his own hands."
Boyack said he might have considered reducing the charge to amisdemeanor if
Tippett had no criminal record.
In the hallway outside of the courtroom after the hearing, Tippettexpressed
disappointment that the judge didn't reduce the charge.
"I didn't mean to kill the cat," he said.
He wasn't on his medication at the time and wasn't thinking straight, he
said.
Beki Medina, who runs We Care Sober Living Recovery Home in Sonora, said
Tippett is a good man who needs help.
He has been with the home for five years, and Medina has never seen him be
violent, she said.
"Prison isn't going to help him," shesaid.
Two members of Sonora Cat Rescueconfronted a group of Tippett's supporters,
with Elsie Sheldon calling out how Tippett had once told her how he hated
cats.
"Lock him up so he can't kill any more cats," she said shortly afterward,
adding that many people think it's OK to hurt cats.
"I think he needs to be made an example of that this is not acceptable
behavior," Sheldon said.
