A Person is handicapped and confined to a wheelchair. One Arm is
bandage as the person moves on the side of The Highway - After asking
me for assistance I got off road first, and said I call a Ambulance
but by the time I was down a way then the person after Wheelchair
Injured person refuse call for Ambulance ask for some money -
A driver somehow dumped the person in the wheelchair onto the road -
not sure what the asking for money was for, and back in the wheelchair
the person continue to move on the side of the road - with the refusal
of call 911. No EMS came to check the person out but which is in
itself refused to go to the hospital.
If few days later the person started to complain about a knee hurting
and having a headache. I'd like to know if the person has a personal
injury case by not having a closer Bus Stop?

ANSWER for "Wheelchair Accident on Handicap Bus...":
Sharon (Interlachen, FL):
The Person does have a personal injury case against the bus company.
The question though is how much money will be involved in a case like
- Hopefully persons injuries aren't too serious. You didn't make clear
the reason the bus company is compelling you to wheelchair for the
person. Certainly if a fall in the bus caused wheelchair to be
damaged, the bus company should at a minimum pay for a new wheelchair.
It would be a good idea to add up your medical bills to date. If your
son's injuries are such that he will require additional medical
assistance be sure to make those amounts known to the bus company or
their insurance representative.
Contact the bus company and tell them you want to file a claim.
Hopefully they will refer you to their insurance company. Once they do
you will be on the right path toward resolving your son's case. In the
event the bus company doesn't cooperate you may have to consider legal
action.
Since laws change frequently and across jurisdictions you should get a
personalized case evaluation froman attorney licensed in your state
(if you haven't already).
