SPECIAL ORDER : No. 12-08-04-02 NO PUBLIC ENTRY
AREA CLOSURE
CUSTER NATIONAL FOREST
ASHLAND RANGER DISTRICT
Pursuant to 36 CFR 261.50 (a) and (b), the following acts are
prohibited on Forest Service Systems Lands described in this order.
All persons are prohibited from going into or being upon National
Forest System Lands within the Area described below, Pursuant to Title
36CFR 261.52(e). These restrictions are in addition to thoseenumerated
in Subpart A, Part 261, title 36 CFR, become effective immediately,
and will remain in effect until rescinded or revoked.
Due to fire activity, all National Forest System lands administered by
the Custer National Forest northof Highway 212 are closed to
pubicentry due to safety concerns for both the public and fire
fighters. These safety concerns are due to fire activity from the Ash
Creek Fire.
Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:
1) Persons with a permit issued by a Forest Service Officer
specifically authorizing the prohibited act.
2) Any Federal, State, or local officer, or member of an organized
rescue or fire fighting force in the performance of an official duty.

Penalty: Violation of these prohibitions is punishable by a fine of
not more than $5,000.00 for anindividual or $10,000.00 for an
organization, or imprisonment for not more than 6 months, or both (16
USC 551, and 18 USC 3559 and 3571-Violations/Penalties and 36 CFR
261.51
Notification:
A copy of this order shall be postedas prescribed in 36 CFR 261.51
